What is ATE Insurance?
If you are not eligible for legal aid or if your application for legal aid was unsuccessful, at J W McNinch Solicitors we can apply for funding of your legal proceedings with the assistance of “ATE” After The Event insurance.
An application is made to the insurance company who will assess your case. If the insurance company decides to fund your case they set a premium amount to be paid by you. You do not pay this premium amount upfront. If you are happy with the premium we will then issue your legal proceedings. Should your case then settle or if the Court awards you compensation, your premium is then paid out of your damages.
If your legal proceedings are unsuccessful and you have compiled with the insurance policy conditions, there is no premium payable by you and the insurance will cover the costs for the third party and your own costs for outlays in bringing your case to Court.
What is “No Win No Fee”?
No Win No Fee is a fee arrangement between clients and their solicitors. These No Win No Fee agreements are not permitted in Northern Ireland by the Law Society and we will not be able to act for you on a No Win No Fee basis.
In Northern Ireland most personal injury cases are settled without the need to issue Court Proceedings with an Insurance Company paying your compensation and all of your legal costs on the successful conclusion of your case. You will keep ALL of your compensation with nothing to be paid for by you.
